授業概要 This course explores how law and the judiciary functions in Japanese society.  The course covers not only the court system – the core dispute resolution system, but also dispute resolution system outside the court (ADR=alternative dispute resolution), the system of the legal profession, access to justice issue, law and gender issue, and so on.  In each class, we will have a small group discussion for 10-20 minutes. Students are expected to actively participate in the class discussion.

Day6 Civil Process (4) How can single case give an impact to society?
We will watch a DVD on mass pollution case.
Day 7 Civil Process (5) Comparative view

Based on the DVD, we will discuss how civil process can change a society.

Day 8 Criminal Process (1) Overview

- How criminal cases are handled in Japan?

【Readings】 Visit the website of Japanese Supreme Court and review the outline of criminal justice.

Day 9 Criminal Process (2) Statistics

We will discuss about current statistics on criminal process.

【Readings】 Read the latest white paper on criminal process.

Day10 Criminal Process (3) Characteristics of Japanese Criminal Process

- Why the lay judge system was introduced?

- Victim's participation system

Day 11 Family Law and Gender Issues (1)

- Why gender matters in the judiciary?

(We will watch DVD and then have either discussion or short essay test.)

Day 12 Family Law and Gender Issues (2)

Based on the DVD, we will discuss more about current trend of gender law in Japan.

Day 13 Civil Control Through the Judiciary
We will review some important Supreme Court Cases and discuss how these cases gave impacts to society.
Day 14 Globalization and law

- How globalization affects Japanese judiciary?

Day15 Final exam
Essay test exam will be taken.
割合 評価基準
試験: 60% Final exam: Essay tests are taken.
平常点評価: 40% Students attendance and short essay tests.
Students are expected to actively participate in class discussion.
